The use of this partial book cover in the article about its subject Sherwood Johnson is fair use. Only part of the cover is being used. This is less than one page of a book of hundreds of pages. Not only does this image not compete with the copyright owner's product, to some extent it even acts as an advertisement for the copyright owner's product, as all book covers do. The resolution is greatly less than the original. The most salient part of the cover is the black and white photo of the subject. This photo was taken in an era when photographs were not automatically copyrighted as they are under the Copyright Act of 1976, and a search of copyright.gov turned up no evidence that this photo was copyrighted upon its taking circa 1954 and then duly renewed circa 1982.
