Fair use for Wall of Voodoo

Though the picture is subject to copyright I (Peter G Werner 07:34, 20 March 2007 (UTC)) feel it is covered by the U.S. fair use laws because:

it is only a 30-second sample of a much longer track.
it does not limit the copyright owner's rights to sell the CD album in any way;
the sample could not be used to make illegal copies of the album artwork on another CD;
the music sample is significant because it was made by a famous artist, Wall of Voodoo, being a notable representation of their sound.

Licensing

This is a sound sample from a song, movie, sound effect, or other audio recording that is currently copyrighted. The copyright for it may be owned by the company who made it or the author. For a song, it may also be owned by the person(s) who performed it. It is believed that the use of this work qualifies as fair use under United States copyright law when used on the English-language Wikipedia, hosted on servers in the U.S. by the non-profit Wikimedia Foundation, where:
