The Freedom of Information (Scotland) Act 2002 (asp 13) is an act of the Scottish Parliament.

Provisions
It covers public bodies over which the Scottish Parliament has jurisdiction.
The public interest test for not disclosing information is stated in terms of "substantial prejudice".[4]
The 2002 act established a Scottish Information Commissioner.[5] Appeals against the commissioner go to the Court of Session.[6]
The 2002 act does not exempt the Scottish Parliament in the way that the Freedom of Information Act 2000 provides an exemption for the Parliament of the United Kingdom.[7]
Implementation
The act came into force on 1 January 2005.[8]
