Casting

  • Tessie Santiago after signing with an agent went, as part of her first professional audition, to an open casting call Fireworks Entertainment was conducting in a nationwide search for the lead role. As a blonde with light skin and light eyes, Santiago knew that TV had a long history of relying on clichés and stereotypes and the typical look of a Latina so she dyed her hair black a week before the audition and read for the part. It led to several callbacks with a final test screening in Los Angeles, California and she won the lead role of Tessa Alvarado.[1]
  • David Abramovitch met Peter Wingfield at a Highlander convention in November 1999 and offered him the parts of Doctor Helm or Captain Grisham. Wingfield chose the doctor as a part with more mileage and more challenging.[2]
  • The part of Colonel Montoya was written for Valentine Pelka by David Abramovitch who phoned Pelka in October 1999 offering the part subject to approval by the other show producers.[3]

Lawsuit

Writer Linda S.Lukens has asked the Los Angeles Superior Court to block the TV series from airing in September unless she was given a "created by" credit because she had originated a script and treatment, also titled "Queen of Swords," two decades after she first sold the idea to ABC.

The writer claimed both she and the executive producer for the series [David Abramowitz] were represented by the same literary agency, the Broder/Kurland Agency, which also is named in the lawsuit.

Sony v Fireworks Entertainment

Following the success of The Mask of Zorro a syndicated tv series called Queen of Swords (QOS) aired in October 2000 and Sony believing they had purchased the rights to the character Zorro from "Zorro Production Incorporated"[4] sued the producers Fireworks Entertainment claiming damages. Some of the salient points being:

  • Tessa Alvarado/QOS is an amalgamation of three Mask of Zorro characters: Elena, Diego (the Zorro played by Anthony Hopkins, "Hopkins Zorro,"), and Murietta (the Zorro played by Antonio Banderas, "Banderas Zorro").
  • Sony also argue that the TV series copied Mask of Zorro's Don Montero to create QOS's Colonel Montoya, and that they copied Mask of Zorro's Harrison Love to create QOS's Marcus Grisham.
  • The first two episodes of Queen of Swords display similar plot elements from Mask of Zorro such as the death of the protagonist's beloved family member at the hands of an expatriate American mercenary, the return of the main female character to Old California from Spain, as well as the protagonist's learning to fight with a sword, donning a black costume and mask to avenge the family member's death, freeing secretly enslaved gold miners, before blowing-up the mine.

The Court noted that since the copyrights in The Curse of Capistrano and The Mark of Zorro lapsed in 1995 or before and the character Zorro has been in the public domain.

Sony was denied its request for an injunction to stop distribution of the syndicated television program Queen of Swords.[5]

The War of the Worlds is a three part drama produced by the BBC of H.G. Counterfiet Queen is the ninth episode of the syndicated television series Queen of Swords airing January 13, 2001

A woman posing as The Queen is captured, after robbing the Santa Monica – Monterey stage, by Colonel Montoya and Captain Grisham and they realise the situation can be turned to their advantage by discrediting The Queen of Swords.
