Copyright infringement

Hello. Please be aware that the continued addition of material sourced to Mediapart and Indigo Publications (Africa Intelligence) is disputed.

According to a complaint made by the subject of the article, these publications have been formally notified that the material in question reproduces copyrighted content without authorization and have been asked to remove it.

While Wikipedia does not adjudicate copyright disputes, re-adding contested material under active legal complaint — particularly where it is negative or reputational — requires strong consensus and careful adherence to WP:BLP, WP:RS, and WP:UNDUE.

Thank you for the note. I acknowledge the request to discuss sourcing on the article talk page and have not reinserted the material pending discussion. However, at present there is no demonstrated community consensus establishing that Mediapart or Indigo Publications (Africa Intelligence) are unreliable with respect to this specific court reporting, nor any consensus showing that the cited material itself is disputed under WP:RS or WP:BLP.
A complaint by the subject of an article to an external publisher—whether relating to copyright or otherwise—does not, on its own, invalidate independently published reporting for Wikipedia purposes. As policy makes clear, Wikipedia does not adjudicate such disputes, and content decisions are based on source quality, independence, and due weight, not on objections or legal pressure from a subject. In addition, WP:COI cautions against allowing subjects or closely connected parties to influence content outcomes, and WP:NOTCENSORED makes clear that material is not excluded simply because it is controversial or unfavorable.

Since copyright is the subject of this thread, I’ll just add that the issue being raised is not for Wikipedia to decide on the merits. However, where material is alleged to reproduce copyrighted content and that allegation is unresolved, extra caution is warranted in how heavily such reporting is relied upon, particularly in a BLP context.
This does not automatically invalidate the sources, but it is relevant to questions of weight, framing, and whether the same material should continue to be reinserted unchanged and without further supporting documentation while concerns are under discussion. Edit Wars & Consensus

Material does not require prior consensus to be removed when it is disputed, non-neutral, or insufficiently supported, particularly in a BLP context. Consensus is required to restore contested material once substantive objections have been raised, not the other way around.

The issue here is that the same content was repeatedly reinserted after removal without addressing concerns about sourcing accuracy, neutrality, and undue weight. That pattern is disruptive regardless of intent.

With respect to COI allegations: no evidence has been presented that I have any financial connection to the subject. I am a resident of the region in question, and I care about my home. I've edited previously about my home (MMTC, Mumias Sugar & related) and have been a contributor for about 4 years. Your account was created this month and has also only ever contributed on MMTC's page, so the question of COI extends to you as well.

Raising sourcing and due-weight concerns, and proposing a reduced, summary-style paragraph in place of detailed allegations, is consistent with WP:BLP and WP:DUE, not advocacy. To move this forward constructively, revised edits have been proposed that significantly reduce detail and summarize the matter neutrally. Discussion should now focus on whether that summary is supported by sources and appropriately weighted, rather than on repeated restoration of previously removed material or speculation about editor motives. Concern over reliability of some sources

I was looking into improving the quality of the history section since I’ve removed a lot of content from it recently as it failed verification. It seemed as though the Construction Kenya article would be a good fit for this. It’s already used for claims elsewhere in the article. I can’t tell exactly when it was published, but the earliest date I can find is that it was both archived and updated on November 30 2022.

Some portions of the article are verbatim what we have had since the inception of this article in 2017. Specifically:

”The mall hosts Mwalmart supermarket, Hamptons Cafe bed and breakfast, showroom and more than 90,000 square feet of private residences.”

other parts are very similar:

CK: ”The third phase of the project, which commenced in September 2017, includes an airport, a 36-hole golf resort, residences, a second mall, a convention centre, and a water park connected to the hospital by a cable car. It will also include a medical school, a technology park, and a 144 MW gasification power plant”

First revision: “The final Phase from September 2017 to December 2020 contains the 36 hole Golf resort and residences, an Airport with the second shopping mall, a convention center and a water park connected to the hospital by a cable car. It will also have medical school, a technology park and a 144 Megawatt gassification power plant.”

I’m concerned this may be WP:CIRCULAR so I’m planning to remove claims cited to this source unless there are any objections? SpelunkerOfMine (talk) 16:02, 24 January 2026 (UTC)

I think I added that content before I understood Wikipedia's COI policy, as I am close to the subject.
The author of that article is a respected Kenyan journalist who would have used primary information provided by MMTC. His source isn't Wikipedia, it is MMTC. Anyone keeping an eye on MMTC developments will consume the same press releases.
So that content is accurate in the sense that this is what MMTC has announced as its plan, and this is what could already be found in the city if you were to visit by that time. There are plenty of people who have visited the city and posted their own comments, photos and videos over the years to corroborate the reality on the ground.
Perhaps instead of removing it entirely, you can help rephrase it for neutrality and compliance with Wikipedia rules? What do you need for sources not to fail verification? FCC2002 (talk) 06:25, 25 January 2026 (UTC)
To be clear are you saying that Mariedl is also your account? If so, did your COI exist when you made those edits?
Hearing the original source is from a press release is concerning - it implies we’re infringing on the copyright of the press release given how similar the wording is. I’ll try to look for the press releases myself, but it sounds like you’re familiar with which press releases this is. If so, could you put a link to it here?
Separately from that, I think if a source is copying uncritically from a press release in their own voice, we should not consider it reliable per WP:NEWSORG (“Press releases from organizations or journals are often used by newspapers with minimal change; such sources are churnalism and should not be treated differently than the underlying press release”) SpelunkerOfMine (talk) 12:02, 25 January 2026 (UTC)
1. No, sorry for the confusion. Mariedl is not my account and I did not actually make those contributions.
2. I am not aware of any formal press releases. The city's growth was mostly low-profile at first, but MMTC's social media, especially Facebook, would be a good place to start.

Excellent. I’ve found 2 sources for the phase 1 section, but neither seem to be especially reliable (or at least, their reliability hasn’t been established yet). I started looking into phase 2 stuff but really struggled to find adequate sourcing around the 5000 beds number.
According to (admittedly probably not reliably sourced) data from Statistica and World Atlas, this would make it the second largest hospital by number of beds.
So I was thinking 5000 beds may be an WP:Exceptional claim and therefore needs exceptional sources, which we don’t currently have imo. If this hospital was the largest in the world, I would have expected international news to have run at least some stories on it.
But looking into the First Affiliated Hospital of Zhengzhou University, there isn’t much non-Chinese media coverage of it. So maybe this is the normal amount of sourcing for such a hospital. SpelunkerOfMine (talk) 14:24, 25 January 2026 (UTC)

It is Mwale himself speaking, but it is published by Forbes, so I’d think we can use some of it. I summarized a few points below, as they may provide useful background about the vision, the torch-bearer thereof, and MMTC’s expansion plans.
Mwale defines the MMTC model, in which he described an “integrated master development plan” that upgrades infrastructure within existing African villages. He stated that the model involves improving roads and housing while structuring developments so that locals retain ownership interests, including acting as landlords for residential units serving employees of the city. I think you’re squeezing more out of the sources than we really should here.

2) only get a mention of most of those countries. This is probably an OK source for involvement in Akon City and Zambia, but I’d want better sourcing for the rest. Building on similar ventures doesn’t make it clear to me that they’re his ventures.
3) no issues, save for a minor tweak in wording. I also found this interview on YouTube from KBC in which Mwale says For example, this entire area of about two subcounties - county - wards - you know for Kakamega, half of those county wards has 25,000 acres. And those are people being affected in this [these?] area[s?]. But we only have 5,000 acres. So we integrated the community. The 20,000 acres is community, 5,000 acres is us. Community is 80%, we are 20%. I’m not sure what he means by the first part, but it does sound like 5,000 acres is a more fair description.
4) I don’t think this has the same controversies as the Mediapart investigation which is what I think you’re referring to here. The bits that stood out to me were the 5000 beds/100 patients per day, no cancer centre discrepancy, the 2 billion company that wasn’t listed on a stock exchange and was later dissolved then revived, and the structure/employees of KE International. The Kenya Times articles only slightly covers the SBA Technologies high rate of return/unpaid bills, but not the rest. I also don’t think this is somehow objective (maybe this is a language/culture barrier, this phrasing feels unnatural to me) - it ends with Mwale’s lawyers described the case as frivolous and malicious,” underscoring his ability to withstand high-stakes legal disputes, the latter half of which I read in the author’s voice, not Mwale’s lawyers’.
We can, and probably should, use this - it’s written by a named author from a source that seems reputable and has an editorial team. But pretending it’s without bias is silly. Nothing is without bias.

The Forbes interview is a WP:PRIMARY source. It’s Mwale talking. A great source for quotes, if we can justify their relevance with secondary sources. But not a reliable source for establishing fact, other than what his ambitions are and what claims he makes.

Regarding the billionaires.africa source, I’m sceptical of the reliability. Maybe it’s just the name though. I’d probably want to take this one to the reliable sources noticeboard unless we have other sources saying the same thing.

On the suggested excerpt, no I don’t think there’s adequate sourcing to make those claims. None of those sources say that these charity events are regular. Many such is likewise not supported by the sources you gave. I’m concerned this is WP:SYNTH given the available sourcing.
We can definitely, with the citizen digital source, say MMTC organises 4 annual events, including a marathon and a health walk, for universal healthcare and promotion of a healthy lifestyle. Whether 4 annually is regular is a matter for interpretation, so I think specifying how many there have been and how often they were is the easiest way to avoid POV here imo. We’d probably want to acknowledge this has been happening for 2 years so far. We can probably use the other sources to support specific years/events.
Interestingly the second citizen digital article appears to contradict billionaires.africa:

Concern over the reliability of The Star (Kenya) and Citizen Digital for statements of fact about MMTC

I’ve been trying to get to the bottom of the 5,000 beds claim (but that’s a topic for another thread) and found the following two articles:

  • Citizen Reporter (2022-01-10). "Hamptons Hospital to distribute solar-powered streetlights worth Ksh.1 billion". Citizen Digital.
  • The Star Reporter (2022-01-10). "hHamptons hospital to distribute solar-powered streetlights worth Sh1 billion". The Star (Kenya).

The first few paragraphs of both are identical. Then The Star has 2 sentences Citizen Digital doesn’t. Then they’re back to being identical.

The Citizen Digital article says it was published earlier in the day (09:40 EAT vs 18:49 unspecified).

They’re both published by unnamed reporters.

I have no evidence to suggest this is the case, but it seems the most likely explanation is that someone external to the news organisations has written this material and the organisations have published it almost unedited. I’m concerned these sources can’t be trusted to be WP:INDEPENDENT and are therefore unreliable.

A no longer maintained as of 2023 BBC Media Guide to Kenya lists both The Star and Citizen TV (which is owned by Royal Media Services, which also owns Citizen Digital), so I think these are reasonably established and mainstream media organisations in Kenya.

Do other editors share the view that these sources should be treated as primary sources for information on MMTC?

We currently use these two sources for a number of claims in the article including:

Citizen Digital: Location, founded by Mwale, receipt of hospital equipment, visits from foreign politicians (has real name), that MMTC has been announced as the African headquarters of various firms

And another with The Star and KBC. The KBC article is written by a named journalist but the Star article is written by Star Reporter again.
The KBC article has breadcrumbs saying it’s from the blog section of the website. So this may be an WP:SPS.
And both Star articles are from their Realtime section, which I think is their breaking news. And per WP:RSBREAKING that would make it a WP:PRIMARY source (All breaking news stories, without exception, are primary sources). SpelunkerOfMine (talk) 12:00, 1 February 2026 (UTC)

I’ve included archive links because the Star articles 404’d for a bit while compiling these lists, but they seem fine now. KBC’s also been failing to load for me for the past few days too.
I've ordered the sources by the date and time they say they were published. Some just tell you, others require you to hover over the date, KBC uses the <time> html tag which I had to "inspect element" to find the time on. The Star doesn't give a timezone but using the publication time and duration an article has been published, it's easy to verify that they use +03:00 (EAT). For Capital FM, I used the <meta> tag with the property article:published_time. There's a good chance I've made some mistakes around timezones when doing this.
I've linked the most relevant Facebook post from MMTC I can find for each instance. These tend not to be the full press release, but most of these articles use wording from the Facebook post without quotation marks at some point.
I'm becoming increasingly convinced that we should treat articles from these sources by unnamed reporters as unreliable. SpelunkerOfMine (talk) 20:55, 7 February 2026 (UTC)
SpelunkerOfMine, thanks for looking into all this. I'm checking on articles with active neutrality disputes and I see you've done a lot of editing on the article since this discussion. The neutrality issues definitely are still present, but mostly only in the lead and the Economy section onward. I’ve gotten as far as the Climate section and have been working on the Economy section, mostly moving things into the History section and making them more neutral (the sources rarely discuss the topics in an economic context).
This is the first neutrality cleanup I’ve participated in, so I’d greatly appreciate a review or even just a cursory check of what I’ve done so far if you have the time.
I realised I didn’t tag all the usages of sources found above, but I’ve now done so. These are mostly still in the article. SpelunkerOfMine (talk) 13:09, 29 March 2026 (UTC)
