アメリカ合衆国では、銃を利用した重大犯罪が度々発生しており、銃規制の是非をめぐって論争となっているが、この条項が根拠となり、銃器の所持が認められ、場合によっては（州によっても差違があるが）携帯も認められる。
ヘラー事件判決
2008年7月、ヘラー事件（英語版）において、合衆国最高裁判所は、修正第2条が個人の武装権を保護するものであることを明確に認めた。具体的には、コロンビア特別区（＝ワシントンD.C.）における、拳銃の所持を事実上禁止する法規定と、家庭内において銃器を「非装填状態で分解またはトリガーロックで固定」するよう義務づける規定が、憲法に違反するとして無効とされた。一方で、この権利はいかなる銃規制をも認めないものではなく、「重罪人や精神障害者による銃器の所持」の禁止や「危険かつ異常な武器の携帯」の制限など、禁止の存在を妨げないことも盛り込んだ[6]。
